1. Scope of this Privacy Policy
This Privacy Policy (the "Policy") describes how Klaus Way and our affiliated companies (hereinafter "we," "us," or "our") collect, use, and disclose personal information when you visit our website at klausway.com (the "Site"), request a free consultation, apply for a job with us, or otherwise contact us about our IT consulting, custom application development, system integration, automation, data analytics, or cloud services (collectively, the "Consulting Services").
For purposes of this Policy, "you" means a visitor to our Site or a prospective client, vendor, or job applicant.
Important note on client and project data. If you engage Klaus Way for Consulting Services, we may build, host, or support custom software applications on your behalf (for example, a CRM, e-signature tool, reporting system, or similar "Client Application"). Where we process personal information within a Client Application, or otherwise process data on your behalf as part of a project, we generally do so as a service provider/processor acting on your instructions, under the confidentiality and data-processing terms of the applicable Services Agreement and/or Data Processing Addendum ("DPA") — not under this Policy. This Policy instead covers (a) personal information we collect from visitors to our Site and prospective clients, and (b) personal information of our clients' authorized contacts needed to manage the business relationship.
By accessing or using our Site, you acknowledge that you have read, understood, and agree to be bound by this Privacy Policy, and you consent to our collection and use of your personal information as described below. If you do not agree, please do not use the Site.
Where required by law, we will obtain additional consent through opt-in mechanisms such as cookie banners or checkboxes. For your rights regarding cookies, see the Cookie Notice below, which forms part of this Policy.
Our Site may link to other websites, including client and partner sites shown in our portfolio. The privacy practices of those sites are governed by their own privacy policies.
2. Information We Collect
2.1. Generally. Most information we collect is submitted directly by you. We may also collect information automatically when you visit our Site, and occasionally from third parties such as business or professional networking platforms.
2.2. Information you provide directly. Depending on how you interact with us, we may collect:
- Contact and inquiry information, such as your name, company, job title, email address, phone number, and project details, when you request a free consultation or submit a contact form.
- Engagement and billing information, such as business address and billing/payment details, if you become a client, collected in connection with the applicable Services Agreement.
- Correspondence, such as the content of emails, calls, or meeting notes exchanged during a proposal or engagement.
- Job applicant information, such as your name, contact details, resume, cover letter, portfolio, and related application materials, if you apply for a position with us. You may be asked equal-opportunity monitoring questions (for example, about gender or ethnicity) where permitted by law, which you are never required to answer.
2.3. Information from other websites and platforms. If you engage with us through a third-party platform (for example, LinkedIn or a professional referral network), that platform may share limited information with us, such as your name and professional details, subject to your settings with that platform.
2.4. Information we collect automatically. When you visit our Site, we and our service providers may automatically collect your IP address, browser and device type, referring/exit pages, pages viewed, and dates/times of visit, using cookies and similar technologies. 3. Our Use of Your Information
We use personal information to:
- Respond to inquiries, including evaluating and responding to consultation requests, preparing proposals, and scheduling calls or meetings;
- Manage client relationships, including administering Services Agreements, invoicing, and providing ongoing support for Consulting Services and Client Applications;
- Communicate with you, including sending requested information and, where you've consented or as otherwise permitted by law, occasional updates about our services or content;
- Operate and improve our Site, including understanding how visitors use it and troubleshooting issues;
- Process job applications, to assess qualifications, communicate about a role, and conduct legally permitted reference or background checks with your knowledge and consent; and
- Meet legal and security obligations, including preventing fraud or misuse of the Site and complying with applicable law.
We do not sell your personal information, and we do not share it with third parties for their own independent marketing purposes.
4. Accuracy, Protection, Minimization, and Retention
4.1. Accuracy. We take reasonable steps to keep the personal information we hold accurate and current, and to delete information no longer needed. Contact us as described in How to Contact Us to request corrections.
4.2. Protection. We use administrative, technical, and organizational safeguards designed to protect personal information against unauthorized access, loss, misuse, or disclosure. No security measure is perfect, and we cannot guarantee absolute security.
4.3. Minimization and retention. We retain personal information only as long as reasonably necessary for the purposes described in this Policy, to comply with legal obligations, resolve disputes, and enforce our agreements. For clients, project-related data is generally retained for the duration of the engagement and for a limited period afterward as set out in the applicable Services Agreement or DPA.
5. Disclosure of Information to Third Parties
We may share personal information with:
- Service providers and subcontractors who help us operate our business and deliver Consulting Services, such as cloud hosting providers, email and scheduling tools, accounting software, and analytics providers, under confidentiality obligations consistent with this Policy.
- Payment processors, for billing clients for Consulting Services.
- Professional advisors, such as lawyers, accountants, and insurers, where necessary for legitimate business purposes.
- Legal and safety authorities, where required by law (such as a court order or subpoena), or where we believe disclosure is necessary to protect our rights, property, or safety, or that of others.
- A successor entity, in connection with a merger, acquisition, financing, or sale of assets, subject to that party agreeing to handle personal information consistent with this Policy, or with notice to you of any material change.
We may also share aggregated or de-identified information that does not identify you, such as for case studies or marketing (only with client consent for named case studies).
6. Your Rights
Subject to applicable law and your location, you may have the right to: (1) access personal information we hold about you; (2) request correction of inaccurate information; (3) request deletion; (4) request restriction of, or object to, our processing; (5) request a portable copy of your information; and (6) withdraw consent where processing is based on consent.
To exercise these rights, contact us as described in How to Contact Us. We may need to verify your identity before acting on a request and may decline or limit requests where permitted by law. We will not unlawfully discriminate against you for exercising these rights.
If your personal information appears within a Client Application we've built or host for one of our clients, please direct data-rights requests to that client (as the data controller); we will support our client in responding in accordance with the applicable Services Agreement and DPA.
You may opt out of marketing emails at any time using the "unsubscribe" link in those emails, or by contacting us directly.
7. Text Messages and Telephone Communications
If you provide us a phone number, we may call or text you regarding your consultation request or an active engagement. Where you have separately opted in, we may also text you about service updates or promotions; message and data rates may apply, and frequency may vary. You can opt out of texts at any time by replying STOP, or by contacting us as described below. We will not sell or share your phone number with third parties for their own marketing purposes.
8. Children's Privacy
Our Site and Consulting Services are intended for business use by adults and are not directed to individuals under the age of 18. We do not knowingly collect personal information from children. If you believe a child has provided us personal information, please contact us so we can delete it.
9. International Users and Data Transfers
We are based in the United States, and personal information we collect may be stored and processed in the United States or other countries where our service providers operate. Where required by applicable law, we will implement appropriate safeguards for cross-border transfers of personal information.
